What is the EB-5 Program?

The employment-based fifth preference, otherwise known as the EB-5 Program was created in 1990 by U.S. Congress to stimulate the U.S. economy through job creation and capital investment by foreign investors. The EB-5 Program allows non-U.S. residents to obtain a permanent Green Card (U.S. permanent residency) by investing in U.S.-based businesses that create at least 10 permanent jobs for each investor. In return for creating new jobs, the EB-5 investor, their spouse, and all unmarried children under the age of 21 receive the permanent Green Cards and a pathway to U.S. citizenship. The EB-5 Program is available to almost all foreign nationals around the world. Foreign nationals already in the United States under other visa programs such as the H-1B would be able to convert from other non-immigrant visas to the EB-5 Green Card and receive permanent residency in the United States.
