EB-5 Green Card in Ten Steps

  1. Confirm your eligibility. Bedrock will confirm you as an “accredited” investor before being able to show you any investment options. This is required by Regulation D of the US Securities Act of 1933. You can complete the questionnaire online using the following link: Click here.
  2. Select your investment. Once confirmed as an accredited investor, Bedrock will provide you information regarding several investments and you can select the investment which appeals most to you. In general, Bedrock focuses on investments that are always similar in nature, mostly real estate investment projects, where the $800,000 investment is structured as a loan or preferred equity with a low interest rate for on average 5 years.
  3. Hire an immigration attorney. Bedrock Group works with numerous attorneys we can recommend. Typically legal fees range on average from $15,000-$25,000 depending on the attorney you choose and the complexity of your case.
  4. Prepare your EB-5 I-526 petition. Once hired, your immigration attorney will provide you with a list of required documents and information (birth certificates, tax returns, etc.) that usually takes 1-3 months to compile. The attorney will also help prepare your source of funds paperwork required to prove your investment comes from lawfully earned money. Usually the most cumbersome process is collecting proof that the source of your $500,000 investment was earned legally, which involves tracing the money back to its origin and source such as payroll records, property sale records, investment records, tax returns, and other forms of financial documentation.
  5. File your I-526 petition. Your attorney files your I-526 petition (your family will be dependents on your petition). Expected total costs to date are the attorney fees, the $800,000 investment, on average a $80,000 administrative fee, the filing fee at USCIS and any miscellaneous expenses you’ve incurred in the process (travel, notarizations, etc.). We use $900,000 USD to $950,000 USD as a range for the total expected costs, but your expenses may vary depending on immigration attorney selected.
  6. Bedrock manages your investment. This is where your investment and immigration processes diverge. Bedrock manages the investment on your behalf; funding the loan to the project. You will receive regular updates and reports on the status of the project and your investment. Normally the EB-5 job creation requirements for our investors is tied to the construction of the project, so as soon as the construction is completed, the required jobs have been created.
  7. Wait patiently. Your petition will wait in a queue at USCIS for approximately 16-36 months depending upon the priority date of your petition before being processed and approved. Current average time is 18-36 months per USCIS’ monthly visa bulletin based upon information available as of March 2023.
  8. Consulate Interview. Once approved, you will be notified and can make an appointment at your country’s US embassy or consulate for an interview. Once approved after the interview, the Consulate will provide you with documents to present to US immigration upon your arrival in the US. At that point, you are now a US conditional resident (Green Card holder).
  9. Confirm your visa responsibilities & File the I-829 petition. Approximately two years after your I-I-526 and I-485 approvals, Bedrock will work with your immigration attorney to prove the job creation. There is a second filing, called Form I-829, to accomplish this requirement. Upon review and approval by USCIS, they will replace you’re conditional green card with the permanent green card which only requires renewal (like a passport) every 10 years.
  10. Completion of the investment. The investment continues separately and will be repaid per its own terms. Bedrock normally works with a five year term and attempt to return the investment earlier when possible, but each project is different. The investment must be at-risk per USCIS requirements, and no guarantee can be made as to its return of or return on investment.
